Salary Hero Company Limited (“We”) is the owner and operator of website and application under the name “Salary Hero” (the “Platform”) that faciliates the salary advancement, gives information relating to financial wellbeing and recomends and/or facilitates the access to the financial services or products to the user (“You”). We intend to inform you of this Privacy Notice (the “Notice”) to let you know the necessity that we rely on when processing your personal data. Therefore, please kindly study this Notice before using the Platform since the process of your personal data is critical for the performance of the Platform and for the provision of the relevant services to You. We reserve the right to reject the access to the Platform and the Service to You if You do not permit us to use your personal data as defined hereunder.

Under this Notice, “Personal Data” means any information that can identify one individual person either directly or indirectly.

Notice Acceptance. In case you contact us and/or choose to use the Platform and/or our services, we shall deem that You permit us to process your Personal Data as defined under this Notice.

Scope of Application. This Notice shall be applicable to the process of Personal Data directly undertaken by us only; however, it should be noted that the Platform may have a link to external website or services (including without limitation the website or service of the financial product provider that You may be interested in using their products, i.e., insurance, credit facilities or saving. In case You click on those website or service provided by the external party, please kindly note that those website or services are beyond our control. Therefore, we would recommend that You should study the privacy notice of the external party that are separate from this Notice and We would not be involved in or responsible for the privacy notice to be announced by those external parties.

We reserve the right to review and revise this Notice from time to time to ensure that the Notice would match the current laws and regulations and be consistent with the scope of services that we are providing; provided that We would notify you of those revisions or amendments via this Platform where the Personal Data will be processed.

Personal Data to be Processed. We may collect your Personal Data from the following sources: (1) directly collected from You when You contact us or when You use the Platform or any communication channel to coordinate with us; (2) collected automatically when You access the Platform or use the services provided by us; or (3) collected indirectly from your employment company who uses our services to faciliate the salary advancement to be provided by such employment company – in case of the employment company, please kindly note that your Personal Data as necessary will be shared with us to assess your qualifications if you would be eligible to use our services.

For the performance of the Platform and the provision of the services by us to You, We would need to collect, compile and process your Personal Data as follows:

1. Your full name, identification card number and contact information (telephone number and email address);

2. Your employment information, including the employment status, employee number, position and salary base (including all the benefits You may be entitled to, i.e., overtime payment);

3. Your request for salary advancement, including without limitation your time attendance, the salary advancement requested and other information that We may request in the request form to be provided via the Platform;

4. Your online identifiers, including IP address, GPS location, type and details of the device that You use to connect the Platform and/or our services, time and date that you use the services, usage statistics and cookies;
5. Information of all the transaction that You execute on the Platform, including your transaction history (i.e. visit and salary advancement requested history) payment information (including bank account details, payment evidence and direct debit consent and information) and any other transactions that you may undertaken on the Platform; and

6. Other Personal Data that You may disclose or share with us during the communication or transaction execution, including without limitation the information relating to the complaint or feedbacks that you may give us.

Purposes of the Personal Data Processing. We would need to collect, compile, use and process your Personal Data for the following purposes:

1. To perform the relevant services by us to You, in particular: (1) to contact and coordinate with you; (2) to verify your identity and eligibility to use the Platform and/or services; (3) to determine the terms and conditions for the services to be provided, in particular to assess your rights to get the salary advancment or the service of being recommended of the financial products that would match your profile; and (4) to exercise any rights and perform any duties that we may have with you that relates to the Platform and/or service, in parricular as defined in the terms of services and other support activities;

2. To perform any statutory duties that We may have, in particular in the preparation of the accounting and tax document and in performing other duties that We may have under the applicable laws that relates to the services that We provide to you;

3. To protect our legitimate rights without excessively violate your rights as the data subject, in particular for the following purposes: (1) to protect our rights in the legal proceeding; (2) to plan the improvement of the Platform and/or services in order to ensure that the Platform would match your needs and interest; (3) to manage our enterprise risk and to prevent fraud in the system; (4) to improve the relationship between you and us via the complaint handling process; (5) to analyze and categorize the user segment for the marketing purposes that is not the direct marketing; (6) to make the PR materials that we may disclose to the general public where your Personal Data (i.e., your photo or testimonials) will be disclosed; and (7) to make the statistic or report relating to the use of the Platform and/or the services either in the form of the Personal Data or the anonymous data; and

4. To use your Personal Data for any other purposes that You may give a consent to us to do so, including without limitation to contact you directly to inform you of the information relating to our services that You may be interested in.

Retention Period. We would need to retain your Personal Data throughout the period of time that We would still need to provide the relevant services to You, in particular throughout the time that You still have the user account on our Platform, even after You are no longer the employee of the employment company that signed up to use our Platform); throughout the time that we may be required to do so under the applicable laws and throughout the time that We may need to retain those information to protect our legitimate rights or for the period of time that We may consider necessary for our business operation.

Disclosure of the Personal Data. In principle, We will not disclose or share your Personal Data to any third party, except in case that is necessary for us to do so that include the following circumstances: (1) to the service provider that we may engage in our performance of the Platform and/or services to you (including without limitation the commercial bank); provided that we will only disclose your Personal Data on the need to know basis and We will ensure that the recipient of your Personal Data shall not disclose or use your Personal Data for any other purpose; (2) to our business partner who provide the relevant financial products that You may be interested in obtaining (including without limitation the insurance, credit facilities or saving providers); (3) to the employment company that You are subject to where We would need to disclose such information for the purpose of us getting the repayment of all the salary advancement that we made; and (4) to government authorities that We may be obliged to disclose your Personal Data to under the laws, judgment or government order.

Your Data Subject Rights. We respect the rights that You have as the data subject under the personal data protection law, including the right to withdraw consent, the right request for access or copy of the Personal Data that We retain, the right to request for data portability, the right to object to personal data processing, the right to request for the deletion or anonymization of your Personal Data, the right to request for the suspension of the Personal Data processing, the right to request to rectify your Personal Data and the right to make any complaints under the applicable laws.
